Repeals

Section 160 repeals the pre-consolidation stamp duty enactments and sets out the transitional arrangements that preserve the old law for matters arising before the Act was passed.

  • The stamp duty provisions of the Stamp Act 1891, the Stamp Duties Management Act 1891 and the Finance Acts up to 1999 are repealed to the extent listed in Schedule 3.
  • The consolidated Act does not apply to Schedule 1 instruments executed, section 116 transactions in uncertificated securities, or levy statements (sections 123 to 126) deliverable, before the date the Act was passed.
  • For those pre-passing instruments, transactions and statements, the repealed provisions continue to apply as if the consolidation had not happened.
  • Penalty provisions of the old law remain in force for offences committed or begun before the Act was passed, and acts done under repealed provisions are treated as done under the corresponding new provisions.
