Interpretation (Chapter 2)

Section 78A sets out the definitions used throughout Chapter 2, which governs the stamp duty treatment of interests in securities that are transferred electronically through a central securities depository.

  • Chapter 2 deals with the electronic transfer of interests in Irish securities held in or through a central securities depository (CSD).
  • It defines the key terms used in the Chapter, most of which are taken or adapted from the EU Central Securities Depository Regulation (Regulation 909/2014).
  • A reference to a CSD includes a third country CSD, meaning a depository located outside the European Union.
  • The Chapter applies only to electronic transfers and not to written instruments such as stock transfer forms.
