Location of insurance risk for stamp duty purposes

Section 61 sets out how the location of an insurance risk is to be determined for stamp duty purposes.

  • Risk relating to buildings (or buildings and their contents under the same policy) is located in the State if the property is situated here, and risk relating to vehicles is located in the State if the vehicles are registered here.
  • For travel or holiday cover lasting four months or less, the risk is located in the State if the policyholder took out the policy in the State.
  • In any other case, the risk is located in the State if an individual policyholder habitually resides here, or if a corporate policyholder's head office (or the branch to which the policy relates) is situated here.
  • "Branch" covers a policyholder's branch or agency in the State and any other permanent presence here, such as an office run by the policyholder's own staff or by an independent agent with permanent authority to act for it.
