Stamp Duties Consolidation Act 1999 section 125

Certain premiums of insurance

Section 125 imposes a 3 per cent stamp duty on the gross amount of non-life insurance premiums received by insurers in respect of risks located in the State, payable quarterly.

  • Stamp duty of 3 per cent applies to the gross premium receipts of an insurer for each calendar quarter, to the extent that the underlying risks are located in the State.
  • Several categories of premium are excluded, including reinsurance, life assurance, health insurance, marine, aviation and transit cover, export credit and certain dental insurance.
  • The insurer must file a statement of the assessable amount with Revenue within 25 days of the end of each calendar quarter and pay the duty on delivery of the statement.
  • Statements must be filed electronically through ROS; late filing or late payment attracts daily interest on the unpaid duty.
