Certain mortgages of stock

Section 107 provided exemptions from stamp duty for certain hand-written instruments used as security for loans involving share warrants, stock certificates and similar securities, but was deleted in respect of instruments executed on or after 7 December 2006.

  • Exempted hand-written instruments given on the deposit of share warrants, bearer stock certificates, foreign share certificates, or securities for money transferable by delivery, when used as security for a loan
  • Exempted hand-written instruments making redeemable or qualifying a duly stamped transfer (or a transfer not chargeable to duty) of registered stock or a marketable security where the transfer was intended as security
  • The exemptions did not extend to promissory notes or bills of exchange
  • Section was deleted by Finance Act 2007 section 100(1)(c) in respect of instruments executed on or after 7 December 2006
