Interpretation (Part 8)

Section 114 provided the definitions for Part 8 of the Act, which imposed companies capital duty on certain transactions undertaken by capital companies.

  • Part 8 imposed a stamp duty, generally known as companies capital duty, on certain transactions of capital companies.
  • The duty was abolished in respect of transactions taking place on or after 7 December 2005.
  • The duty originated from Council Directive 69/355/EEC of 17 July 1969, as amended by later directives in 1973, 1974 and 1985.
  • For the purposes of Part 8, the Isle of Man, the Channel Islands and Gibraltar were not treated as falling within the definition of "Member State".
