Recovery of stamp duty and furnishing of information

Section 122 dealt with the recovery of companies capital duty and gave the Revenue Commissioners the powers needed to gather information for assessing that duty.

  • Companies capital duty was charged on certain capital transactions of capital companies before 7 December 2005.
  • The capital company itself was primarily accountable for the duty and any interest arising on it.
  • Where the capital company was not a body corporate, its members were made jointly and severally liable for the duty.
  • The Revenue Commissioners were given powers to obtain any information they required for the purposes of administering the duty.
