Decree or order for foreclosure, etc, and stamp duty

Section 39 dealt with the stamp duty treatment of foreclosure decrees and any conveyance that followed such a decree.

  • Ad valorem stamp duty on a foreclosure decree or order could not exceed the duty chargeable on the value of the property concerned.
  • Where the decree or order stated the value of the property, that statement was conclusive for determining the duty payable.
  • Where ad valorem duty was paid on the foreclosure decree, any subsequent conveyance following from that decree was exempt from ad valorem stamp duty.
  • This section was repealed by Schedule 2 Part 5 of the Land and Conveyancing Law Reform Act 2009.
