Reconstructions or amalgamations of certain common contractual funds

Section 88C provides a stamp duty exemption for instruments executed for the purposes of, or in connection with, a scheme for the reconstruction or amalgamation of certain common contractual funds.

  • No stamp duty arises on any instrument made for the purposes of, or in connection with, a scheme of reconstruction or amalgamation of a common contractual fund (CCF).
  • The CCF concerned must be one to which section 739H(3) of the Taxes Consolidation Act 1997 applies.
  • The exemption was inserted by section 107 of the Finance Act 2006 and applies to instruments executed on or after 31 March 2006.
  • A CCF is a collective investment vehicle established under the Investment Funds, Companies and Miscellaneous Provisions Act 2005.
