Certain instruments made in anticipation of a formal insurance policy

Section 109 exempts cover notes and similar documents made in anticipation of the issue of a formal non-life insurance policy, as well as documents that amend the terms of such policies, from stamp duty.

  • No stamp duty arises on cover notes, slips and similar instruments made in anticipation of a formal non-life insurance policy.
  • No stamp duty arises on instruments that alter the terms or conditions of a non-life insurance policy.
  • The exemption does not apply to anything connected with life insurance.
  • A document exempted under this section is not treated as a policy of insurance for stamp duty purposes.
