Stamp Duties Consolidation Act 1999 section 92A

Residential property owner occupier relief

Section 92A provided a stamp duty reduction for owner-occupier purchases of dwellinghouses or apartments, but it is now spent and does not apply to any instrument executed on or after 6 December 2001.

  • Reduced stamp duty on owner-occupied residential purchases to nil at the lowest band and to scaled fractions of the normal duty at higher bands.
  • Required a certificate that the purchaser, or someone in their right, would occupy the property as an only or principal residence.
  • Imposed a five-year clawback if rent (other than rent-a-room income from 6 April 2001) was derived from the property.
  • Ceased to apply to instruments executed on or after 6 December 2001 following its replacement by the wider relief regime.
