Certain loan stock

Section 86 exempts transfers of the loan stock of certain State bodies from stamp duty.

  • No stamp duty arises on a transfer of loan stock of a company registered or established in the State, or of a Board established by Act of the Oireachtas (including the former Oireachtas of Saorstát Éireann), where the Minister guarantees payment of the interest on that stock.
  • The exemption also covers the loan stock of the Electricity Supply Board, Radio Telefís Éireann and Bord Gáis Éireann, even where no Ministerial guarantee of the interest applies.
  • By virtue of the Housing Finance Agency Act 1981, the benefit of the exemption extends to bonds, debentures and other securities issued by the Housing Finance Agency.
  • This exemption is wider in scope than the related exemption found in section 85(2)(b).
