Declaration of non-corporate person

Paragraph 11 of Schedule 2B sets out the requirements for a non-residency declaration by a non-corporate unit holder, which allows an investment undertaking to pay gains without deducting exit tax.

  • A unit holder who is neither resident nor ordinarily resident in the State may make a written declaration to the investment undertaking to avoid exit tax on gains.
  • The declaration must be made and signed by the person entitled to the units, using a form prescribed or authorised by the Revenue Commissioners.
  • The declarer must include their name and address, confirm their non-resident status, and undertake to notify the investment undertaking if they become resident in the State.
  • The declaration must also contain any other information the Revenue Commissioners may reasonably require for the purposes of Chapter 1A of Part 27.
