Taxes Consolidation Act 1997 section 891A

Returns of interest paid to non-residents

Section 891A requires companies and collective investment undertakings that pay interest exempt from withholding tax under section 246(3)(h) to file an information return with Revenue detailing those payments.

  • A return must be filed for each chargeable period listing the name, address, and country of tax residence of each recipient of relevant interest.
  • The return must state the amount of interest paid to each recipient during the chargeable period.
  • Where interest is reported under this section, the separate reporting obligation under section 891 does not apply to those payments.
  • Penalties under sections 1052 and 1054 apply to any failure to file the required return.
