Paragraph 26 sets out the rules for fixing the price at which scheme shares may be acquired on the exercise of rights obtained under an approved savings-related share option scheme.

  • The acquisition price must be stated at the time the right is obtained.
  • The price must not be manifestly less than 75% of the market value of shares of the same class at that time.
  • An earlier valuation date may be used if agreed in writing between Revenue and the grantor company.
  • The scheme may provide for the price to vary to reflect any variation in the share capital of which the scheme shares form part.
