Returns in relation to settlements and trustees

Section 896A requires professionals involved in creating settlements (trusts) to report certain details to Revenue where the settlor is Irish-resident but the trustees are not.

  • A person who, in the course of a trade or profession, is involved in making a settlement must report it to Revenue if the settlor is resident or ordinarily resident in Ireland but the trustees are not resident here
  • The statement must include the settlor's name and address, the names and addresses of the trustees, and the date the settlement was made
  • For settlements made on or after 24 December 2008 the statement must be delivered within 4 months; for settlements made in the 5 years before that date, within 6 months of 24 December 2008
  • An authorised Revenue officer may require any person believed to hold information about a settlement to provide that information within a specified timeframe
