Taxes Consolidation Act 1997 section 848F

Declaration on commencement

Section 848F set out the requirements for the declaration that every qualifying individual was required to complete and sign when opening a special savings incentive account (SSIA).

  • The declaration had to be in writing, signed by the qualifying individual, and given to the qualifying savings manager in a form prescribed or authorised by the Revenue Commissioners.
  • It had to contain the individual's name, permanent residence address, PPS Number, and date of birth, together with a reference to the offence of making a false declaration under section 848T.
  • The individual was required to declare that he or she was resident in the State, had not commenced another SSIA, would beneficially own the qualifying assets, would subscribe from his or her own resources (or those of his or her spouse) without recourse to borrowing, and would not pledge the assets as security for a loan.
  • The individual had to undertake to advise the qualifying savings manager if the declaration ceased to be materially correct at any time.
