Taxes Consolidation Act 1997 section 959AO

Date for payment of income tax

Section 959AO sets out the due dates for the payment of preliminary tax and income tax, and the consequences where preliminary tax requirements are not met.

  • Preliminary tax is due on or before 31 October in the tax year, and the balance of income tax is due by the specified return date (31 October of the following year)
  • If preliminary tax is not paid, is insufficient, or is paid late, income tax for the year is deemed due on 31 October in the tax year, meaning interest runs from that earlier date
  • Preliminary tax is sufficient if it equals at least 90% of the current year liability, 100% of the prior year liability, or (for direct debit payers) 105% of the pre-preceding year liability
  • Special rules apply for jointly assessed spouses or civil partners, for taxpayers who were not chargeable persons in prior years, and for adjustments arising under section 65(3)
