Returns of interest payments made to or secured for beneficial owners

Section 898H requires paying agents to file annual returns with the Revenue Commissioners detailing interest payments made to beneficial owners resident in relevant territories, as part of Ireland's obligations under the EU Savings Directive.

  • Paying agents must file returns within 3 months of the end of each tax year, covering interest payments made to beneficial owners resident in relevant territories, starting from 1 July 2005.
  • Each return must include the paying agent's own details (name, address, and tax reference number), details of each beneficial owner, and details of the interest payments made.
  • The beneficial owner details required depend on when the contractual relationship was established: pre-2004 contracts require name, address, and country of residence, while contracts from 1 January 2004 onwards also require a tax identification number (TIN) or, failing that, date and place of birth.
  • Interest payments already reported under this section are exempt from the general reporting obligations under sections 891 and 891A, preventing duplication of returns.
