Interaction of relief with other provisions of this Act

Section 600O sets out how angel investor relief interacts with other capital gains tax reliefs, including revised entrepreneur relief, retirement relief, and the relief schemes under Part 16.

  • Where a disposal of eligible shares qualifies for both angel investor relief and revised entrepreneur relief (section 597AA), the relief producing the lower CGT liability takes precedence.
  • Similarly, where a disposal qualifies for both angel investor relief and retirement relief (section 598 or 599), the more favourable relief applies instead.
  • Where revised entrepreneur relief or retirement relief takes precedence, angel investor relief does not apply to that disposal.
  • Angel investor relief is not available for any disposal of eligible shares where the investor has claimed, or intends to claim, relief under the Part 16 schemes (including the Employment Investment Incentive, the Start-Up Capital Incentive, and Start-Up Relief for Entrepreneurs).
