Taxes Consolidation Act 1997 section 913

Application of income tax provisions relating to returns, etc.

Section 913 applies the income tax provisions relating to returns, statements, production of documents and related obligations to capital gains tax, with any necessary modifications, and provides for the furnishing of information regarding acquisitions of assets.

  • Income tax rules on filing returns, producing documents and giving notice of liability apply equally to capital gains tax, subject to any necessary modifications
  • Revenue may require particulars of assets acquired from 6 April 1974 onwards, including who the asset was acquired from and the consideration paid, but excluding exempt assets and trading stock
  • Transfers of shares or debentures on company reconstructions or amalgamations that do not trigger a CGT charge must still be reported as disposals or acquisitions in returns
  • Partnership returns must include details of disposals and acquisitions of partnership assets, and returns of a married woman's chargeable gains may be required from either spouse where joint assessment applies
