Zoning submissions

Section 653I allows a landowner to request the local authority to change the zoning of land included in a draft, supplemental or revised map, and sets out the procedures for evaluating and responding to such requests.

  • A landowner may make a written submission to the local authority requesting a change to the zoning of land on a draft map, supplemental map or revised map, within specified deadlines for each map type, with the most recent opportunity relating to the revised map for 2026 published by 31 January 2026.
  • The local authority must publish submissions on its website within 10 working days of receipt, subject to exceptions for vexatious, libellous or confidential material, and must issue a written acknowledgement confirming whether there is an extant planning permission or current planning application for residential development on the land.
  • A landowner who makes a rezoning request on a revised map can claim an exemption from RZLT, but the exemption does not apply to land (or any part of it) that is the subject of an extant planning permission or current planning application for residential development.
  • The local authority must evaluate each submission, decide whether to propose a variation to the development plan or reject the request, and notify the landowner within the applicable deadline.
