Continuity

Section 372AV ensures that the consolidation of the residential relief provisions into this Chapter does not disrupt the continuity of the law, and that all prior actions, deductions, orders and authorisations under the repealed legislation continue in force under the new consolidated provisions.

  • The operation of income tax, corporation tax and CGT law continues unaffected by the replacement of the old residential relief enactments with this consolidated Chapter.
  • References in any document or legislation to either the old or the new provisions are to be read interchangeably, and anything done under the repealed law is treated as done under the corresponding consolidated provision.
  • Deductions previously given under the old enactments are treated as given under this Chapter, and references in existing orders to the repealed sections are re-mapped to sections 372AP and 372AR as appropriate.
  • All officers authorised or nominated, and all instruments or documents issued, under the old enactments before the passing of Finance Act 2002 continue in force under this Chapter.
