Returns, payment and collection of IREF withholding tax

Section 739R regulates the time and manner in which Irish real estate funds (IREFs) must file annual returns and account for and pay IREF withholding tax to the Collector-General.

  • Every IREF must file an annual return for each accounting period, with deadlines of 30 January (for periods ending on or before 30 June) or 30 July (for periods ending between 1 July and 31 December of the prior year).
  • IREF withholding tax is due and payable to the Collector-General at the same time as the return is filed, and the collection and enforcement rules for investment undertakings under section 739F apply with any necessary modifications.
  • Where an IREF taxable event has occurred during the period, the return must include specified details for each unit holder, including name, address, TIN, unit holding, taxable event amount, and withholding tax deducted.
  • The return is submitted as an Excel file through Revenue's MyEnquiries system, and payments are made by electronic funds transfer to Revenue's designated bank account, quoting the IREF customer reference number.
