Estimate of tax due

Section 959AX empowers Revenue to raise estimated assessments for income tax and corporation tax where a chargeable person fails to file a return by the specified return date.

  • Where a return is not filed on time, a Revenue officer may estimate the tax due for the chargeable period and serve a written notice on the chargeable person specifying the estimated amount.
  • The estimate is set at the average of the tax due on the two most recent returns filed by the person, or €1,000, whichever is greater.
  • The estimated tax is recoverable as though the person had actually filed a return showing that amount due, allowing Revenue to use normal collection and enforcement procedures.
  • The estimate may be displaced within 30 days if the person files the outstanding return and pays the tax due (together with any interest, penalties and surcharges), or notifies Revenue in writing that they are not a chargeable person for the period.
