Taxes Consolidation Act 1997 section 728

Expenses of management

Section 728 restricts the management expenses relief available to an overseas life assurance company to those expenses attributable to its Irish branch or agency.

  • An overseas life assurance company may claim relief for expenses of management under section 707.
  • However, the relief is limited to expenses attributable to the life assurance business carried on at or through the company's branch or agency in the State.
  • Management expenses relating to the company's operations outside the State are excluded from the relief.
  • The restriction ensures that only expenses connected with the Irish business activity qualify for deduction.
