Obligation to pay preliminary tax

Section 952, now deleted, dealt with the obligation on chargeable persons to pay preliminary tax and the rules governing when and how such payments must be made.

  • A chargeable person must pay preliminary tax for each chargeable period unless the inspector has already raised an assessment before the payment due date.
  • Income tax preliminary tax is due on or before 31 October in the tax year, while corporation tax preliminary tax follows separate rules for small and large companies.
  • Large companies with accounting periods commencing on or after 14 October 2008 must pay preliminary corporation tax in two instalments, in months 6 and 11 of the accounting period.
  • Preliminary tax does not apply to capital gains tax, though a separate system of advance final tax payment operates in its place.
