Exchange of information between Member States

Section 898J authorises the Revenue Commissioners to exchange information on interest payments with the competent authorities of other EU Member States and relevant territories.

  • Revenue may communicate return information on beneficial owners of interest payments to the competent authority where the beneficial owner is resident.
  • Revenue may similarly communicate return information on residual entities to the competent authority where the residual entity is resident.
  • All such information must be communicated within 6 months of the end of the tax year in which the interest payment is made.
  • The EU Savings Directive was repealed with effect from 1 January 2016 and replaced by the mandatory automatic exchange of information regime under Directive 2014/107/EU (see section 891G).
