Taxes Consolidation Act 1997 section 914

Returns by issuing houses, stockbrokers, auctioneers, etc.

Section 914 empowers Revenue inspectors to require returns from issuing houses, stockbrokers, auctioneers and certain other persons giving particulars of business transactions, for the purpose of verifying chargeable gains.

  • An inspector may require share issuing houses, stockbrokers, share dealing agents, auctioneers and dealers in tangible movable property to make returns of specified transactions.
  • Returns must include particulars of the parties involved, the number or amount of shares or securities (or items of property) dealt with, and the consideration paid.
  • Auctioneers and dealers must report transactions in tangible movable property where the consideration exceeds €19,050 (or €6,350 for transactions between 6 April 1994 and 5 April 1995).
  • No return may be required for transactions effected more than 3 years before the date the notice is served, and Revenue may require returns to be submitted in an approved electronic format.
