Interpretation

Section 489 defines terms used throughout Part 16 in relation to qualifying companies for the purposes of the employment investment incentive scheme (EIIS).

  • Relevant trading activities are those taxed under Case I of Schedule D, but exclude a range of specified activities such as dealing in financial assets, financing activities, professional services, land dealing or development, hotel management (unless a tourist traffic undertaking), and film production.
  • A RICT group comprises the company in question together with its partner businesses and linked businesses, and extends to include subsidiaries of the qualifying company during the compliance period regardless of when they became subsidiaries.
  • An SME is a RICT group that falls within the small and medium-sized enterprise category under Annex 1 of the EU General Block Exemption Regulation.
  • An unlisted company is one whose shares, stock, or debentures are not listed on a stock exchange, other than on the Euronext Growth market operated by Euronext Dublin or an equivalent market in another EU member state, EEA state, or the United Kingdom.
