Trade unions

Section 213 provides an income tax exemption for registered trade unions whose investment income is used for provident benefits or the education and training of members.

  • A registered trade union restricted to assuring no more than €10,160 as a lump sum or €2,540 per year by annuity is exempt from income tax on its interest and dividends, provided these are used solely for provident benefits or the education, training or retraining of members and their dependent children.
  • Provident benefits include payments to members during sickness, incapacity, unemployment or old age, payments following accidents or loss of tools, and contributions towards funeral expenses for a member, their spouse or civil partner, or provision for the children of a deceased member or their civil partner.
  • Claims for the exemption must be verified in the manner specified by the Revenue Commissioners, and proof may be given by the treasurer, trustee or any duly authorised agent of the trade union.
  • A person who makes a false or fraudulent claim for this exemption in respect of income chargeable under Schedule C is liable to forfeit €125.
