Declaration to be made by pension scheme

Paragraph 4 of Schedule 2A sets out the requirements for the written declaration that a pension scheme must provide in order to receive relevant distributions without deduction of dividend withholding tax (DWT).

  • A pension scheme that wishes to receive distributions free of DWT must provide a written declaration to the company making the distribution.
  • The declaration must be made and signed by the person beneficially entitled to the distributions, using a Revenue-prescribed form.
  • It must confirm the beneficial owner's status as a pension scheme, include the scheme's name and tax reference number, and be certified by the scheme's appropriate person.
  • The declarer must undertake to notify the paying company in writing if the pension scheme ceases to qualify as an excluded person.
