Taxes Consolidation Act 1997 section 784BA

Annual returns by qualifying fund managers

Section 784BA requires qualifying fund managers to file annual electronic returns with Revenue detailing the assets, distributions, and fund holder information for each approved retirement fund they administer.

  • A qualifying fund manager must file an electronic return with Revenue within three months of the end of each year of assessment, covering every ARF administered during that year.
  • The return must include extensive information for each ARF, including the fund holder's identity, tax reference number, country of residence, asset details, income and gains arising, and all distributions made.
  • Where a transaction is deemed to be a distribution, the return must separately identify the recipient, the amount, and the tax the qualifying fund manager is required to account for.
  • A penalty of €3,000 applies for each failure to file a return, or for each incorrect or incomplete return submitted.
