Returns relating to non-resident companies and trusts

Section 917 empowers Revenue to require persons connected with non-resident companies or trusts to provide information needed to determine whether a capital gains tax liability arises.

  • Revenue may serve a notice on any person who holds shares or securities in a company that is not resident in the State.
  • Revenue may also serve a notice on any person who has a beneficial interest in, or acts as agent for a beneficiary of, a settlement whose trustees are not resident in the State.
  • The notice requires the person to provide whatever particulars Revenue considers necessary to establish whether the company or trust falls within the capital gains tax anti-avoidance provisions of sections 579 to 579F and section 590.
  • The information sought is used to determine whether chargeable gains have accrued to the non-resident entity in respect of which the Irish-connected person is liable to capital gains tax.
