Rate of tax at which repayments are to be made

Section 460 sets out the rules governing the rate at which repayments of income tax are made where a person is entitled to allowances, deductions or reliefs.

  • Repayments of income tax arising from allowances, deductions or reliefs are made at the standard rate or the higher rate, as appropriate.
  • Where a person has no taxable income for a year of assessment, the full amount of tax paid β€” whether by deduction at source or otherwise β€” is repayable.
  • The amount repaid cannot exceed the difference between the tax actually paid and the tax that would have been properly payable under the Income Tax Acts.
  • Repayments of DIRT are restricted to specific categories: charities (section 266) and individuals aged 65 or over or who are incapacitated (section 267).
