Taxes Consolidation Act 1997 Schedule 2A, paragraph 6

Declaration to be made by collective investment undertaking

Paragraph 6 of Schedule 2A sets out the requirements for the declaration that a collective investment undertaking must make in order to receive relevant distributions without deduction of dividend withholding tax.

  • A collective investment undertaking that is beneficially entitled to relevant distributions may make a written declaration to the company paying those distributions, enabling payment without DWT.
  • The declaration must be signed by the beneficial owner, made on a Revenue-prescribed form, and must confirm the recipient's status as a collective investment undertaking.
  • The declaration must include the undertaking's name and tax reference number, along with any other information Revenue may reasonably require.
  • The declarer must undertake to notify the paying company in writing if the collective investment undertaking ceases to be an excluded person for DWT purposes.
