Date for payment of capital gains tax

Section 959AQ sets out the due dates for payment of capital gains tax, splitting the tax year into an initial period and a later period with separate deadlines for each.

  • CGT on gains arising in the initial period (1 January to 30 November) is due on or before 15 December in the same tax year.
  • CGT on gains arising in the later period (1 December to 31 December) is due on or before 31 January in the following tax year.
  • Where a subsequent assessment issues, the tax shown on that assessment is deemed to have been due and payable on the same dates as applied to the initial and later periods.
  • These payment obligations apply regardless of whether a formal assessment has been made at the time the tax falls due.
