Establishment of Board

Section 10 establishes the Board of the Authority and sets out its governance responsibilities, accountability to the Minister, and power to delegate functions.

  • The Authority must have a Board to perform its functions, and the Board must ensure appropriate internal systems, procedures and practices are in place for performance management, strategic objectives and annual targets.
  • The Board is responsible for establishing and implementing arrangements to manage the performance of the chief executive.
  • The Board is accountable to the Minister for the due performance of its functions and must inform the Minister in writing of any matter requiring the Minister's attention.
  • The Board may delegate functions in writing to a committee or to the chief executive, but cannot delegate its core governance and performance oversight responsibilities.
