Further power to make regulations

Section 66 empowers the Minister to make regulations governing a wide range of practical and administrative matters relating to the operation of the automatic enrolment contributions system.

  • The Minister may require employers to provide the Authority with information about emoluments, contributions, and the commencement or cessation of employees' employment, on or before making payments.
  • Regulations may set the priority of automatic enrolment contribution deductions over other payroll deductions, except for income tax, PRSI, and USC, which take precedence.
  • The Minister may regulate how contributions apply in non-standard situations, such as share-based remuneration, deemed payments of emoluments, changes of employer, and post-employment payments.
  • Provision is made for regulations to address system failures β€” where the Authority's electronic system, an internet service provider, or an electricity provider is not functioning β€” so that employers are not penalised for non-compliance caused by technology outages.
