Summary proceedings

Section 133 authorises the National Automatic Enrolment Retirement Savings Authority to bring and prosecute summary proceedings for offences under the Act.

• The Authority may initiate summary criminal proceedings for any offence created by the Act.
• The Authority may prosecute those proceedings in its own name.
• This is a standard enforcement provision giving the regulator direct prosecution powers in the District Court.
• Summary proceedings are less serious criminal matters heard without a jury, subject to standard time limits and penalties.
