Automatic Enrolment Retirement Savings System Act 2024 section 98

Confidentiality

Section 98 requires the Authority to protect the identity of participants and their personal representatives when transferring moneys to the Dormant Accounts Fund or notifying the NTMA.

  • When the Authority transfers moneys to the Dormant Accounts Fund under section 93, it must not identify any participant or personal representative by name.
  • The same anonymity requirement applies when the Authority gives notice to the NTMA under section 97(1)(b).
  • The prohibition extends beyond names to any information that could allow a person to be identified as a participant or personal representative.
  • This ensures that the privacy of individuals is maintained throughout the dormant account transfer and notification process.
