Removal of member of Board

Section 16 sets out the grounds and procedures for the Minister to remove a member of the Board from office, including the member's right to make representations before a final decision is taken.

  • The Minister may remove a Board member on the recommendation of the Board or the Pensions Authority on specified grounds, including failure to discharge duties, ill-health, stated misbehaviour, operational necessity, or a significant conflict of interest.
  • Before removing a member, the Minister must give written notice setting out the reasons for the proposed removal and informing the member of their right to make representations within 20 working days (or a longer period if natural justice requires it).
  • The Minister must take into account any representations made by the member, along with any other relevant matters, before reaching a final decision on whether to proceed with the removal.
  • Where the Minister decides to remove a member, the member must be notified in writing with reasons and an effective date, and a written statement of the decision and reasons must be laid before each House of the Oireachtas and provided to the relevant Oireachtas Committee.
