Regulations for purposes of data protection

Section 112 empowers the Minister to make regulations prescribing how personal data may be processed for the purposes of the automatic enrolment system.

• The Minister may prescribe the types, forms, and circumstances of data processing permitted under the Act, including specifying to whom personal data may be disclosed.
• Regulations may specify which categories of personal data may be processed and set suitable safeguards to protect the fundamental rights and freedoms of data subjects.
• Where health data is involved, additional protective measures may be prescribed beyond the standard safeguards.
• The Minister may set time limits for how long each category of personal data may be retained and processed, and where possible, specify deadlines for erasure.
