Right to opt-out

Section 54 sets out the opt-out windows during which a participant may apply to the Authority to opt out of the automatic enrolment retirement savings system.

  • A participant may apply to the Authority to opt out during specific time periods known as "opt-out windows", and the Authority will assign an opt-out date.
  • Each opt-out window runs from more than 6 months to not more than 8 months after a triggering event β€” essentially months 7 and 8 after enrolment, re-enrolment, or the end of a specified multi-year period.
  • The triggering events include: receipt of notice of enrolment, receipt of notice of re-enrolment, and the end of years 1–3, years 4–6, and years 7–9 respectively.
  • A participant who opts out is treated as having opted out from their assigned opt-out date until any subsequent re-enrolment date.
