Automatic Enrolment Retirement Savings System Act 2024 section 55

Automatic re-enrolment

Section 55 provides for the automatic re-enrolment of persons who have previously opted out of the automatic enrolment retirement savings system.

  • Where a person has opted out, the Authority must check whether they qualify for re-enrolment by reference to a proposed re-enrolment date and, if so, assign that date as their re-enrolment date.
  • A person qualifies for re-enrolment if the proposed date falls after 2 years from the opt-out date, the person is under pensionable age, and the person is an employee in non-exempt employment on that date.
  • The re-enrolment process is automatic β€” the individual does not need to apply or take any action to be brought back into the system.
  • The Authority must notify both the individual and their employer of the re-enrolment determination and the re-enrolment date.
