Section 8 establishes the National Automatic Enrolment Retirement Savings Authority (An tÚdarás Náisiúnta um Uathrollú Coigiltis Scoir) as a corporate body and sets out its standard legal powers and formalities.

• The Authority is established on establishment day as a body corporate with perpetual succession and an official seal, and is referred to throughout the Act as the "Authority".
• It can sue and be sued in its own name, and may acquire, hold and dispose of land or other property with the consent of the Minister and the Minister for Public Expenditure, National Development Plan Delivery and Reform.
• The Authority's official seal must be authenticated by the signatures of any two Board members, or by one Board member together with an authorised member of staff.
• Contracts or instruments that would not require a seal if entered into by an individual may be executed on the Authority's behalf by any person generally or specially authorised by the Authority.
