Ineligibility to become and disqualification to act as member of Board

Section 15 sets out the grounds on which a person is ineligible for appointment to the Board of the Authority, or on which an existing Board member must cease to hold office.

  • Staff members of the Authority cannot serve on the Board, and a person convicted on indictment of any offence β€” whether in the State or abroad β€” is disqualified from Board membership.
  • A conviction for any offence involving fraud or dishonesty, regardless of whether it is tried on indictment, also disqualifies a person from serving on the Board.
  • Persons who are subject to a restriction declaration or a disqualification order under the Companies Act 2014 β€” which prevent individuals from acting as company directors or secretaries β€” are likewise ineligible.
  • A person who enters into a composition or arrangement with creditors, who is adjudicated bankrupt (unless the bankruptcy has been annulled or discharged), or who is struck off a professional register by a competent authority, is also disqualified.
