Powers of authorised officers

Section 122 sets out the powers of authorised officers to enter workplaces, inspect records, require information and assistance, and creates offences for obstruction or non-cooperation.

  • Authorised officers may enter places of work, inspect and copy books, records and documents (including those in non-legible form), remove them if reasonably necessary, and require persons present to provide information and assistance.
  • Authorised officers may be accompanied by other authorised officers or members of the Garda SΓ­ochΓ‘na, but may not enter a dwelling without the occupier's consent or a District Court warrant.
  • It is an offence to obstruct or interfere with an authorised officer, or to fail to comply with a requirement, or to give false or misleading information.
  • Any statement or admission made by a person in response to a requirement under this section is not admissible as evidence in proceedings against that person, other than for an offence of obstruction or giving false information.
