Costs

Section 134 provides that a person convicted of an offence under the Act must pay the Authority's costs relating to the investigation, detection and prosecution of the offence, unless the court finds special and substantial reasons not to make such an order.

  • Where a person is convicted of an offence under the Act, the court must order that person to pay the Authority's costs and expenses in relation to the offence.
  • The costs and expenses covered include those incurred in the investigation, detection and prosecution of the offence.
  • The amount of costs and expenses to be paid is measured (i.e. assessed) by the court.
  • The court may decline to make a costs order only where it is satisfied that there are special and substantial reasons for not doing so.
