Interpretation (Part 9)

Section 120 defines the key terms used throughout the compliance and enforcement part of the Act, including what constitutes a "record," what it means to "participate" in the auto-enrolment system, and how employer contribution obligations are to be understood.

  • An "authorised officer" is a person appointed under section 121, while a "compliance notice" and a "fixed payment notice" are formal enforcement tools defined in sections 123 and 124 respectively.
  • A "record" is defined very broadly to include not only written documents but also audio recordings, visual recordings, film, photographs, and any copies or transcripts derived from these formats.
  • "Participating" in the automatic enrolment system covers both applying to join and continuing as a contributing participant, including by choosing not to opt out or not to suspend contributions.
  • References to contributions payable by an employer encompass both the employer's own contributions and the participant contributions that the employer is responsible for deducting and remitting.
